Terms & Conditions

1. To participate in the Campaign, the participant will need to: (a) upload pictures and videos on www.forwardwalidiwali.com and generate AI based images, videos and photographs, that can be downloaded and shared by the participant; (b) then the participant shall visit www.forwardwalidiwali.com and login by correctly filling in all the details (such as, participant’s name, mobile number and email address/google email id, etc.) and upload the said AI generated images, videos and photographs. The entry, including without limitation, any video, images or any other material submitted or recorded in any manner by the participant for the Campaign shall collectively be referred as the “Content”.
2. The participant may upload a photograph or image of any person, individual or personality (including a public figure or celebrity) only where the participant has all rights, permissions, consents and lawful authority required to submit, process, generate AI-based Content from, and share such photograph or image for the purposes of the Campaign. The participant represents and warrants that the Content is lawfully obtained and submitted and that such submission, processing and use will not violate any applicable law or any person’s rights, including privacy, personality, publicity, image, likeness, copyright or other intellectual property rights.
3. All uploaded selfies must be the participant’s original work. Any use of copyrighted or non-original content will result in disqualification.

   Participants are prohibited from submitting selfies that contain:

   • Obscene, pornographic, or otherwise offensive material
   • Violence, threats, or hate speech
   • Defamation or infringement of any person’s rights
4. The participant shall not upload Content that falsely suggests or implies that any person depicted has endorsed, approved, is affiliated with, or is participating in LTF or the Campaign, or that otherwise impersonates or misrepresents such person.
5. Images of individuals without their permission or of minors without their guardian’s permission,

Without limiting the foregoing, the participant shall, to the extent permitted by applicable law, indemnify, defend and hold harmless LTF, its affiliates, directors, officers, employees and assigns from and against any third-party claim, complaint, action, loss, damage, liability, cost or expense (including reasonable legal fees) arising out of or relating to any photograph or image of another person or personality submitted by the participant, including any alleged lack of consent or permission, infringement or violation of privacy, personality, publicity, image, likeness or other rights, defamation, impersonation or misuse. LTF shall not be responsible for obtaining permissions or independently verifying the participant’s rights in the Content.

1. The participant acknowledges that LTF does not select, supply or control photographs or images uploaded by participants and does not endorse, verify or warrant the identity, rights, permissions, accuracy or appropriateness of any person or image uploaded by a participant.
2. In case of any third-party dispute due to submission of entry by any participant, the participant agrees to indemnify LTF, its affiliates, its directors, its employees and assigns against any such third-party claim.
3. Participant agrees to not conceal or misrepresent any information during the scrutiny or otherwise, failing which the participant shall be disqualified for participating in the Campaign.
4. Participants agree to release and hold harmless LTF from any claims, damages, losses, liabilities, and expenses related to their participation in the Campaign or any breach of these Terms and Conditions.

1. Participants’ entering the Campaign shall be deemed as his/her acceptance of the terms and conditions. Mere submission of the entry does not give any warranty or guarantee of publication in LTF’s feature.
2. LTF reserves the right to change, alter or cancel this Campaign in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Decision of LTF in this regard and in general with respect to this Campaign and the Terms & Conditions thereto shall be final, binding and non-contestable.
3. Nothing contained herein amounts to a commitment or representation by LTF to conduct further or other campaigns.
4. LTF reserves the right to withdraw and/or alter any of the terms & conditions of this Campaign at any time without prior notice.
5. To the extent permitted by applicable law, LTF shall not be liable for any claim, loss, damage or liability arising from or relating to a participant’s submission, processing, generation, publication, sharing or use of Content depicting any other person or personality, including any alleged violation of such person’s privacy, personality, publicity, image, likeness or other rights. Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.

1. LTF expressly disclaims all warranties of any kind, whether express or implied.
2. LTF is not responsible for any technical failures or malfunctions of any kind, including but not limited to computer or mobile hardware or software issues, data loss, or any other errors that may affect the submission, generation, or transmission of entries.
3. The participant is solely responsible for obtaining any consent, release, licence or permission required from each identifiable individual depicted in the Content, including any public figure or personality and, where the individual is a minor, from their parent or legal guardian. The participant shall retain evidence of such permissions and provide it to LTF upon request.
4. LTF shall not be liable for any damages, losses, or injuries sustained as a result of participating in the Campaign, the use or misuse of the AI-generated images, or acceptance of any prizes.
5. In no event shall LTF be liable under these terms for any loss to the participant for any error or omission or any consequential, special, indirect, exemplary, punitive, or any loss of profit, goodwill or opportunity or other damages, including, arising out of any failure or alleged failure to perform any of its obligations under these terms whether based in contract, tort (including negligence) or otherwise.
6. Where Content includes an identifiable person other than the participant, the participant represents that all legally required notices, permissions and consents for submission and processing have been obtained and that such processing is otherwise lawful. The participant is responsible for any third-party personal data included in the Content.

1. By submitting an image or photograph and generating an AI image through the Campaign, participants grant LTF a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, and publicly display the selfie and AI-generated image for promotional and advertising purposes.
2. Participants represent and warrant that they have full legal rights to their submitted selfies and that their participation does not infringe on the rights of any third parties.
3. The AI-generated images remain the intellectual property of LTF and can be used for commercial and non-commercial purposes without any obligation to provide additional compensation to the participants.

1. By participating in the Campaign, participants agree to the collection, use, and storage of their personal data, including but not limited to their selfie, name, and contact information. This data will be used solely for the purpose of administering the Campaign, generating AI images, and, where applicable, contacting winners.
2. Participants also consent to their AI-generated images being used by LTF for marketing, promotional, and advertising purposes, including but not limited to social media posts, email campaigns, and website features, without further compensation.
3. All participant data will be securely stored and only retained for the duration necessary to complete the Campaign.

This Campaign shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the jurisdiction of the Courts at Mumbai, India only.

The Campaign and any AI-generated Content are provided on an “as is” and “as available” basis. LTF does not represent or warrant that any AI-generated image, photograph or video will be accurate, authentic, suitable, non-infringing or free from errors, and does not verify the identity of any person depicted or the participant’s rights, permissions or consents in any uploaded photograph or image. Participants are solely responsible for their Content and for obtaining all permissions and consents required for its upload, processing, generation, publication and sharing. LTF shall not be responsible for any use or misuse of Content by a participant or any third party, or for any claim arising from such Content, including claims relating to privacy, personality, publicity, image, likeness, defamation, impersonation or intellectual property rights, except to the extent liability cannot be excluded under applicable law.
